Terms of Service

Welcome to eSharax. These Terms of Service ("Terms") govern your access to and use of the eSharax website, software, API, and associated services (collectively, the "Service"). By creating an account or utilizing our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

eSharax provides an enterprise-grade, AI-powered software application designed to programmatically convert documents (e.g., PDFs) into branded, zero-edit presentation files (e.g., .pptx). We utilize proprietary client-side rendering and machine learning algorithms to enforce strict brand and design constraints.

2. Enterprise Data & Intellectual Property

Your Data: You retain complete ownership of all documents, text, logos, hex codes, and data you upload to the Service ("User Content"). We claim no intellectual property rights over your User Content.

Our Engine: eSharax retains all rights, title, and interest in the Service, including the underlying algorithms, client-side vector engine, templates, and UI/UX designs. You may not reverse engineer, decompile, or attempt to extract the source code of the Service.

3. AI Processing & Zero Public Training Guarantee

We understand the sensitive nature of enterprise data. eSharax strictly guarantees that your User Content is processed solely for the purpose of generating your requested output. Your data is never used to train our models, nor is it shared with public Large Language Models (LLMs) for training purposes. All uploaded documents are held ephemerally during processing and are immediately purged from our active memory post-generation unless explicitly saved in your account hierarchy.

4. User Obligations & Acceptable Use

You agree not to use the Service to:

• Upload confidential data for which you do not have authorization or legal rights to process.
• Generate presentations that contain unlawful, defamatory, or malicious content.
• Attempt to bypass our security protocols or rate limits.
• Resell or redistribute the Service without a formal enterprise reseller agreement.

5. Subscription, Billing, and Cancellation

Access to premium features requires a paid subscription. Fees are billed in advance on a monthly or annual basis and are non-refundable. You may cancel your subscription at any time; your access will remain active until the end of your current billing cycle. Enterprise clients with custom API quotas are subject to the specific terms outlined in their Master Services Agreement (MSA).

6. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Somalia, without regard to its conflict of law provisions. Any dispute arising from these Terms or the use of our Service shall be subject to the exclusive jurisdiction of the competent courts located in Banadir, Mogadishu.
